Initial Comments:


Based on the findings of an onsite unannounced state relicensure survey completed October 21, 2021, Golden Health Services Inc., was found to be in compliance with the requirements of PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart A, Chapter 51.

Based on the findings of an onsite unannounced state relicensure survey completed October 21, 2021, Golden Health Services Inc., was found NOT to be in compliance with the following requirement(s) of PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart H, Chapter 611, Home Care Agencies and Home Care Registries.

Prohibitions

(b) No individual as a result of the individual's affiliation with a home care agency or home care registry may assume power of attorney or guardianship over a consumer utilizing the services of that home care agency or home care registry. The home care agency or home care registry may not require a consumer to endorse checks over to the home care agency or home care registry.

Observations:


Based upon review of the agency admission packet, employee handbook/policies, Consumer files, and interview with the acting Administrator, it was determined that the agency failed to provide information to the Consumer and/or the Direct Care Worker that it is prohibited from assuming power of attorney, or requiring a consumer to endorse checks over to the agency while utilizing services for four, (4), of four, (4), consumer ' s records (CR), reviewed. (CR #1, 2, 3, and 4).

Findings include:

On October 21, 2021 at approximately 10:30 a.m., a review of the agency admission packet titled, "Golden Health Services," revealed no prohibitions to prevent or warn the Consumer or individuals associated with the agency from assuming power of attorney, or requiring a consumer to endorse checks over to the agency.

On October 21, 2021 at approximately 10:40 a.m., a review of the agency policies addressed in the "Employee Handbook" revealed, no prohibitions that addressed or prevented individuals from assuming power of attorney, or requiring a consumer to endorse checks over to the agency while associated with the agency.

1. A review of CR #1 on October 21, 2021, at approximately 10:50 a.m., revealed a start of service on February 13, 2015. There was no evidence of written information provided to the Consumer that the agency was prohibited from assuming power of attorney, or requiring a consumer to endorse checks over to the agency while utilizing agency services.

2. A review of CR #1 on October 21, 2021, at approximately 11:00 a.m., revealed a start of service on February 29, 2016. There was no evidence of written information provided to the Consumer that the agency was prohibited from assuming power of attorney, or requiring a consumer to endorse checks over to the agency while utilizing agency services.

3. A review of CR #1 on October 21, 2021, at approximately 11:15 a.m., revealed a start of service on October 24, 2020. There was no evidence of written information provided to the Consumer that the agency was prohibited from assuming power of attorney, or requiring a consumer to endorse checks over to the agency while utilizing agency services.

4. A review of CR #1 on October 21, 2021, at approximately 11:30 a.m., revealed a start of service on November 2, 2020. There was no evidence of written information provided to the Consumer that the agency was prohibited from assuming power of attorney, or requiring a consumer to endorse checks over to the agency while utilizing agency services.

On October 21, 2021, at approximately 1:00 p.m., while conducting an the interview with the Administrator it was confirmed that there was no documentation in the admission packet, employee handbook/policies, or consumer records that identified the above prohibitions.






Plan of Correction:

Action Plan:

The administrator has updated the policy manual to contain information related to prohibiting any employee or representative of the agency to serve as a power of attorney for any client and/or receiving check or money on behalf of the agency. This was completed by November 11, 2021.


The administrator has educated all staff on the policy of prohibiting any employee or representative of the agency to serve as power of attorney for any client and/or receive check or money on behalf of the agency. The In-service education was completed by November 11, 2021.

The administrator has updated all patient admission packet to contain written information stating that the agency, agency employees or individuals representing the agency are prohibited in acting as the client's power of attorney and/or receive check or money on behalf of the agency by November 11, 2021.


The administrator will provide to all active clients a written addendum to the admission packet and the patient's case manager will educate the patient/patient representative stating that the agency, agency employees or individuals representing the agency are prohibited in acting as the client's power of attorney and/or receive check or money on behalf of the agency by November 20, 2021.

Based on the findings of an onsite unannounced state relicensure survey completed October 21, 2021, Golden Health Services Inc.,
was found to be in compliance with the requirements of 35 P.S. 448.809 (b).
